    Canada Spouse Visa

Canada is one of the most well-known countries that prioritizes family reunification. The Canadian Federal Government allows permanent residents or citizens to sponsor their spouse or common-law partner to live with them through a Canada spouse visa.

Apart from their spouse or common-law partner, permanent residents or citizens can sponsor their dependent child or parents to live with them in this maple country.

The Canada spouse visa processing time differs from other visa programs because it has different requirements.

This guide will provide every detail about how to apply for a Canada spouse visa from India and the processing fees for a spouse visa Canada. However, before proceeding, let us give you a brief insight into the Canada partner visa.

What is a Canada spouse visa?

A spouse visa allows your spouse to live and work overseas. When you are already in a country and would like your overseas spouse or civil partner to join you. Overseas nationals refer to your partner who is living abroad.

As part of the immigration process, you must sponsor your partner’s application to join you as a dependent.  Getting a spouse visa is considered one of the fastest ways to settle in Canada as a permanent resident.

However, the fiancé of Canadian citizens or permanent residents is not eligible for this visa program. Further, candidates must prove the legality or authenticity of their marriage or relationship.

Who is eligible to sponsor their spouse, partner, or child?

As an eligible candidate, you can sponsor your spouse, partner, or child if

    • You’re at least 18 years old.
    • You’re a permanent resident or citizen of Canada or on a legal visa.
    • You can prove that you are not getting any social assistance for reasons other than a disability.
    • You can provide for the basic needs of any persons you want to sponsor.

Whom can you sponsor as dependents?

You can sponsor the following candidates as dependents.

    • Your spouse

Your spouse can be either gender and must be:

    1. Legally married to you.
    2. At least 18 years old.
    • Your common-law partner

    1. Isn’t legally married to you
    2. It can be either gender.
    3. Is at least 18 years old
    4. Has been living with you for at least 12 consecutive months, meaning you’ve been living together continuously for one year in a conjugal relationship without any long periods apart.

(Any time spent away from each other should have been)

    • Short
    • Temporary

If you or your common-law partner choose to end the relationship, we consider the relationship to be over. You’ll need to give proof of your common-law relationship.

    • Your conjugal partner

    1. Isn’t legally married to you or in a common-law relationship with you
    2. It can be either gender.
    3. Is at least 18 years old.
    4. Has been in a relationship with you for at least one year.
    5. Lives outside Canada.
    6. Can’t live with you in their country of residence or marry you because of significant legal and immigration reasons, such as their marital status (for example, they’re still married to someone else in a country where divorce isn’t possible)
    7. Their sexual orientation (for example, you are in a same-gender relationship, and same-gender relationships are not accepted, or same-gender marriage is illegal where they live).
    8. Persecution (for example, your relationship is between different religious groups that are not accepted, and they may be punished legally or socially)

You’ll need proof that you could not live together or get married in your conjugal partner’s country (for example, evidence of refusal to stay long-term in each other’s country).

    • Dependent children

Children qualify as dependents if they meet both of these requirements:

    1. They’re under 22 years old.
    2. They don’t have a spouse or common-law partner.

    1. They are unable to support themselves financially because of a mental or physical condition.
    2. They have depended on their parents for financial support since age 22.

Except for age, your dependent child must continue to meet these requirements until we finish processing your application.
