Australia Partner Visa

The Australia Student Visa is a progressive opportunity for professionals seeking permanent residency in Australia with the help of their partners, who are already permanent residents or citizens of Australia. The Department of Home Affairs accepts applications under three major categories:

❖  Subclass 309/100

Subclass 309/100 is also a category for Australia partner visa, applicable for individuals who will apply for the respective visa while residing outside Australia, commonly known as offshore applicants.  Prospective immigrants who are partners or spouses of Australian permanent residents or citizens have to initially apply for the Subclass 309, also known as the Provisional visa, which enables them to stay and reside in the country until they receive a Permanent Partner visa. While residing in the country with a provisional visa, applicants later apply for Subclass 100, also known as the Partner Migrant visa. 

❖  Subclass 820/801

Subclass 820/801, the partner visa pathway for applicants who are at present residing in Australia, known as the onshore applicants. Partners or spouses of Australian permanent residents initially have to apply for the Subclass 820, which enables them to live in Australia on a temporary basis.

When an applicant holds a Subclass 820, a temporary partner visa, they later apply for a Subclass 801 visa, which enables them to stay in Australia permanently. 

❖  Subclass 300

Subclass 300, also known as the Prospective Marriage visa, which enables individuals to come to Australia to marry their prospective spouse, and then they can apply for a partner visa. With this visa, applicants can stay in the country for 9 to 15 months from the date of visa grant.

Eligible partners residing in Australia who desire to become permanent residents of Australia certainly apply for an Australia partner visa or an Australia spouse visa.

Eligible partners who are at present residing outside Australia and wish to apply for the Australia partner visa are required to hold certain eligibility requirements for the Subclass 309 partner visa. 

Subclass 309 (Provisional) Australia Partner Visa 

❖  not had a visa cancelled or an application refused

❖  be outside Australia while applying

❖  Have a valid sponsor, as it should be the same sponsor while applying for the permanent partner visa

❖  Must be above 18 years of age

❖  meet relationship requirements, as the partner of de facto partner should be an Australian permanent resident or citizen

❖  meet health and character requirements

❖  the applicant must not hold any debt to the Australian Government

❖  signed agreement of the Australian values statement 

Subclass 100 (Migrant) Australia Partner Visa

❖ Must be outside Australia while applying

❖  Must hold a partner (provisional) Subclass 309 visa

❖  Must continue to meet relationship requirements

❖  Meet health and character requirements

❖  Must not hold any debt to the Australian government

To be eligible for the Australia partner visa from inside Australia, applicants must meet certain eligibility requirements for the Subclass 820 visa and later the Subclass 801 visa, such as:

❖  Must be 18 years and above

❖  Be in Australia while applying for the visa

❖  Hold a sponsorship for a partner to migrate to Australia in an online form

❖ Evidence of sponsor’s status

❖  Two statutory declarations stating the two are legally married

❖  Do not hold any regional visa, such as subclass 491, in the last three years

❖  Have a valid sponsor who remains the same while applying for the permanent visa

❖  Meet health and character requirements 

Subclass 801 Partner visa Australia Requirements

❖  Must be 18 years and above

❖  Must hold a subclass 820 partner visa

❖  Must meet the continuing relationship requirements, as the sponsor should be the same when applying for the Subclass 820 visa

❖  meet health and character requirements

❖  thje applicant do not hold debt in regard to the country
